ChenBaekXi Faces First Hearing in Contract Enforcement Lawsuit Against SM Today
ChenBaekXi faces the first hearing in its lawsuit against SM today.
Both parties transitioned to litigation after a failed mediation process.
The court will address issues related to profit settlement and provisional seizure.

Today (April 23), the first hearing in the contract enforcement lawsuit between the EXO unit ChenBaekXi and its management company SM Entertainment will take place at the Eastern District Court of Seoul. This lawsuit, initiated by SM against ChenBaekXi, follows a failed mediation process, leading to the current litigation.

The conflict arose in June 2023 when ChenBaekXi announced its intent to terminate its exclusive contract, claiming insufficient profit settlement data and an unfairly long contract period, subsequently filing a complaint with the Fair Trade Commission. SM countered these claims, stating it had provided adequate settlement data. Additionally, SM has filed for a provisional seizure worth 2.6 billion KRW against the three members, with individual amounts set at 300 million KRW for Chen, 1.6 billion KRW for Baekhyun, and 700 million KRW for Xiumin.

Initially, both parties reached an agreement in June 2023, but disagreements continued, with ChenBaekXi claiming that SM had not honored promised distribution rates. Legal actions were anticipated, as SM also brought up the issue of the 10% revenue-sharing agreement not being fulfilled.

The ongoing dispute between ChenBaekXi and SM transcends mere contractual disagreements and highlights critical issues around artist rights and profit sharing within the Korean music industry. In a landscape where the influence of management companies is substantial, doubts persist regarding whether artists receive fair treatment. This lawsuit brings these questions to the forefront, illustrating the essential process of finding balance between artists and their agencies.

Moreover, given that ChenBaekXi enjoys solid support from their fanbase, their actions are under intense scrutiny. Fans possess a deep desire to see artists' rights respected, generating high expectations for potentially positive outcomes from this lawsuit. By publicizing their conflict with SM, ChenBaekXi raises awareness, which could lead to broader implications for the K-Pop industry.

Finally, this situation serves as a reminder of the ongoing tensions between commercial interests and personal creative desires within K-Pop. The push for autonomy and fairness in the artist-management relationship underscores the need for such considerations in the evolution of the K-Pop industry.
